Terms and Conditions

1. Scope

These terms apply to the use of the web and mobile application “GENA Interior”, which lets users upload photos of their own rooms, analyse them and redesign them with AI.

2. Conclusion of contract

The user contract is concluded when you register an account. The Free plan is free of charge; paid plans are shown separately in the ordering process.

GENA may be used from the age of 16; you confirm your minimum age when registering. Paid plans may only be taken out by adults, or by minors with the consent of their legal guardians.

3. Services and quotas

The range of functions (number of projects, generations, available modules) depends on the selected plan and is shown in the application. In the Free plan, the quota is counted per calendar month (5 generations) and resets at the start of each month. The paid plans also have monthly quotas that reset at the start of each calendar month. Unused quotas do not carry over. Paid plans can be booked with a monthly or yearly term; monthly plans renew for one month at a time, yearly plans for one year at a time, unless cancelled to the end of the current term.

4. AI results — important notice

Analyses, measurements and generated images are produced by artificial intelligence. They are estimates or visualisations and may differ from the real room. Measurements are not suitable for construction planning, structural engineering or binding purchase decisions. Product suggestions including prices come from external sources; only the information provided by the respective retailer is authoritative.

5. User obligations

You only upload photos for which you hold the necessary rights.
No photos in which third parties can be identified without their consent.
No illegal content and no abusive or automated overuse of the service.

6. Reporting illegal content

You can report illegal content to us at any time by email to gena-interior@evasto.cloud (Art. 16 Digital Services Act). Please state the content concerned or its link, a justification, and your name and email address. We review every report promptly, block or remove illegal content, and inform both the reporting person and the affected user of our decision and the reasons for it.

7. Rights of use

Your uploaded photos remain yours. You grant us the processing rights needed to provide the service (storage, AI processing). For generated images you receive a simple, unlimited right of use for private purposes. Commercial use of generated images is only permitted in the “Pro” plan.

8. Prices, term, cancellation

Paid plans have a term of one month or one year and renew for the booked term; they can be cancelled at any time to the end of the current term (directly in the app). On cancellation the account moves to the Free plan. An upgrade to a higher plan takes effect immediately; the period already paid is credited pro rata. For paid plans you expressly agree in the ordering process that the service starts immediately; your right of withdrawal therefore expires when the contract begins (§ 18 FAGG). Without this consent no paid contract is concluded.

9. Availability and liability

We provide the service with reasonable care but do not owe uninterrupted availability. We are liable without limitation for intent and gross negligence and for injury to life, body and health. In cases of simple negligence we are only liable for breaches of essential contractual obligations, limited to the damage typically foreseeable for this type of contract.

10. Final provisions

Austrian law applies, excluding its conflict-of-law rules. For consumers, mandatory protective provisions of the country of their habitual residence remain unaffected. If the user is a business, the place of jurisdiction is the registered office of Evasto GmbH. Should individual provisions be invalid, the remainder of the contract remains effective.
